Terms of Service
These Terms of Service ("Terms") govern access to and use of the website operated under the Chicago CMM Calibration brand at chicago-cmm-calibration.com (the "Site"). By submitting a quote request, contacting the directory, or otherwise interacting with the Site, the user ("you") agrees to be bound by these Terms.
1. Description of the Service
The Site operates as a request-routing platform. Chicago CMM Calibration is not a calibration laboratory, does not perform calibration work, and does not hold ISO/IEC 17025 accreditation, NIST traceability registration, or any other professional calibration credential. The function of the Site is limited to:
- Receiving calibration requests from buyers;
- Routing requests by ZIP code, equipment family, and standard requirement to a third-party calibration laboratory (a "Listed Provider") whose published scope of accreditation matches the request;
- Facilitating direct contact between the buyer and the Listed Provider.
All measurement, calibration, certification, and reporting work is performed by the Listed Provider under its own quality management system, scope of accreditation, and contract with the buyer.
2. No Calibration Services Performed by Chicago CMM Calibration
Nothing on this Site constitutes an offer by Chicago CMM Calibration to perform calibration, measurement, dimensional inspection, or any other technical service. Chicago CMM Calibration makes no representation that it holds or will hold any laboratory accreditation, certification, or license. References on the Site to ISO 10360, ISO/IEC 17025, ASME B89, NIST traceability, or other standards describe the technical scope under which Listed Providers operate — not credentials held by Chicago CMM Calibration.
3. Provider Listing and Vetting
Listings are reviewed against scope-of-accreditation coverage at the time of inclusion. Chicago CMM Calibration does not independently audit a Listed Provider's calibration uncertainty budget, calibration interval discipline, technician training records, or quality management system. The buyer retains responsibility for verifying that a Listed Provider's documented scope, accreditation status, and uncertainty estimates are adequate for the buyer's downstream audit requirements (including but not limited to AS9100, IATF 16949, and ISO 9001).
4. No Warranty on Routing Outcome
Routing decisions are based on data supplied by the buyer (ZIP code, equipment family, standard required, delivery preference) and on Listed Provider scope at the time of routing. Chicago CMM Calibration provides routing on an "as-is" basis and makes no warranty, express or implied, that:
- A Listed Provider will accept the request, will be able to schedule within the buyer's target window, or will quote pricing acceptable to the buyer;
- The routed Listed Provider is the best available provider for the request;
- The calibration work, once contracted between the buyer and the Listed Provider, will meet a specific outcome.
5. Independent Service Agreement
Any calibration work is contracted directly between the buyer and the Listed Provider under that Listed Provider's terms. Chicago CMM Calibration is not a party to that contract, does not collect payment for that contract, and has no authority to vary its terms.
6. Buyer Responsibility
The buyer is responsible for providing accurate equipment information (make, model, serial, current calibration interval), standard-of-acceptance requirements, and environmental constraints. Inaccurate or incomplete information may result in routing to a provider whose scope does not match the actual equipment or in pricing that does not reflect the actual work required.
7. Industry-Specific Disclaimers
Information on the Site about calibration standards (ISO 10360 family, ASME B89 family, ISO/IEC 17025, ISO 10360-12, ASME B89.4.22), artifact sets, performance characteristics (MPE_E, MPE_P), and uncertainty budgets is provided as background context only. It is not technical advice, does not substitute for the calibration certificate issued by the Listed Provider, and must not be relied on for conformance reporting, audit defense, or regulatory submission.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Chicago CMM Calibration disclaims liability for indirect, consequential, special, incidental, exemplary, and punitive damages arising out of or related to use of the Site or the routing of any calibration request. Chicago CMM Calibration's aggregate liability for any claim arising out of use of the Site shall not exceed one hundred US dollars (USD 100.00). This limitation applies regardless of the legal theory under which the claim is brought.
9. Indemnification
The buyer agrees to indemnify and hold harmless Chicago CMM Calibration, its officers, employees, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of: (a) the buyer's breach of these Terms; (b) the buyer's submission of inaccurate or misleading equipment or contact information; or (c) any dispute between the buyer and a Listed Provider regarding calibration work performed under the contract between them.
10. Intellectual Property
The Site, including its layout, copy, schematic illustrations, and trademarks, is the property of Chicago CMM Calibration or its licensors. Limited license is granted to view and print Site content for personal, non-commercial reference. Republication, scraping, automated extraction, or commercial reuse without prior written permission is prohibited.
11. User Conduct
Users may not: (a) submit requests on behalf of a third party without authority; (b) submit knowingly false equipment information for the purpose of soliciting a quote not reflective of the real work; (c) interfere with the Site's security or routing logic; or (d) use the Site to send unsolicited commercial communications to Listed Providers.
12. External Links
The Site may link to external pages — accreditation bodies (A2LA, NVLAP), standards organizations (ISO, ASME), or Listed Provider websites. Chicago CMM Calibration is not responsible for the content, security, or privacy practices of external sites linked from the Site.
13. Modifications
Chicago CMM Calibration may update these Terms at any time. The effective date at the top of this document indicates the date of last revision. Continued use of the Site after a revision constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or use of the Site shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and the parties consent to the personal jurisdiction of those courts.
